1) About Us & Scope
These Terms & Conditions (“Terms”) govern purchases of goods and services from Simforge Engineering, Plot No-44, GAT No-661, Kolwadi, Pune-412110, India. GST: 27ABVPO9462A1Z6 (“Simforge”, “we”, “us”).
These Terms apply to orders placed on our website and to orders confirmed by email. “Client”, “you” means either a consumer (a natural person acting outside a trade) or a trader (acting in the course of business). Client terms deviating from these Terms do not apply unless we agree in writing. Browse our product range or contact us for pre-sale queries.
2) Product Listings, Orders & Contract Formation
- Product pages are invitations to treat, not binding offers.
- You may order via our checkout or by emailing pitstop@simforge.in.
- A binding contract forms after we receive payment and send an order confirmation. If we do not confirm within a reasonable time, no contract arises.
- We store essential order data as required by law.
- You can correct input errors during checkout. After checkout, requests to amend an order must be emailed to pitstop@simforge.in and are possible only until dispatch.
- Contract language: English. We communicate primarily by email; ensure our emails can reach you.
3) Right to Refuse, Pricing & Verification
- We may refuse, cancel, or limit any order (including after payment) if we suspect fraud, misuse, unauthorized resale, sanctions/export issues, or listing/price errors. If payment was taken, we’ll promptly refund the cancelled items.
- Despite care, typographical, pricing, or availability errors may occur. We may correct such errors and cancel orders placed under incorrect information.
- Orders may require additional verification; we may request ID/address/payment proof. Failure to provide may result in cancellation and refund.
4) Prices, Taxes, Currency & Chargebacks
- Prices include applicable Indian GST unless stated otherwise. Shipping and add-ons are shown at checkout.
- International orders: you are responsible for customs duties, import/VAT/GST, brokerage, and any local taxes in your country. We generally do not collect non-Indian taxes unless expressly stated.
- Currency conversions/fees are handled by your bank or payment provider; conversion losses and gateway fees are your responsibility and are not refundable.
- If a chargeback occurs, we may suspend warranty service and further deliveries until resolved; if not reversed, we may pursue recovery.
5) Shipping, Delivery, Customs & Risk
- We ship to the delivery address you provide.
- If the carrier returns a parcel because delivery was impossible (wrong/incomplete address, uncollected parcel, refusal), you bear the cost of the unsuccessful dispatch and any return shipping.
- Delays, non-delivery, or returns caused by carriers, customs, strikes, or events beyond our control do not make us liable for damages.
- If you refuse a shipment due to import fees, original and return shipping costs are not refundable.
- Delivery timeframes are estimates, exclude customs clearance, and missed estimates do not entitle you to compensation or cancellation unless required by law.
- Risk & title: Consumers—risk passes on delivery; Traders—risk passes on hand-over to the carrier; if you appoint a carrier not offered by us, risk passes at hand-over.
- We may part-ship orders. Each consignment may be invoiced/tracked separately.
6) Force Majeure
We are not liable for failure or delay caused by events beyond reasonable control, including acts of God, epidemics, war, government actions, port closures, carrier failures, power outages, or supply-chain disruptions. Our performance is suspended for the duration of the event.
7) Cancellation (Pre-Dispatch)
- Consumers may cancel before dispatch by emailing pitstop@simforge.in.
- If accepted, refunds are processed at the scheduled ship date of the next production batch to your original payment method where possible.
- Where our payment gateway charges non-refundable processing fees, those may be deducted from the refund where permitted by law.
8) Returns & Refunds (Post-Delivery)
- Return window: request a return within 10 days of delivery by emailing boxbox@simforge.in with order number, photos, and reason. See more on our Support page.
- Returns require our written authorization and an RMA number. Unauthorized returns may be refused and returned at your cost.
- Items must be unused, in original packaging, and complete with all accessories/documents.
- Refunds are issued after inspection; if items are damaged, missing, used, or not returnable, a reduced refund or rejection may apply.
- Original shipping is not refundable; you pay return shipping and remain responsible until we receive the goods (use tracked/insured service).
- We are not liable for returns lost/damaged in transit to us.
- Non-refundable gateway fees and any duties/taxes we cannot reclaim may be deducted where permitted by law.
- Non-returnable (unless defective under mandatory law): custom/special-order items, clearance/open-box items, consumables, cut-to-length materials, downloadable software/keys, gift cards/vouchers, and spare-parts kits.
- Restocking: we may deduct a restocking fee up to 15% to cover inspection/repackaging/admin (not applied to statutory defect returns where prohibited by law).
9) Warranty
- Statutory warranty rights apply.
- Scope: defects in materials/workmanship under normal, intended use following our assembly and safety guidance.
- Exclusions: wear and tear; cosmetic damage; improper assembly/mounting; over-torqueing; misuse; modifications; third-party alterations; accidents; corrosion/environment; electrical damage from incorrect power supplies; use outside recommended ranges.
- Third-party compatibility (hardware/firmware/software/games) is not guaranteed unless expressly stated on the product page.
- Remedy: at our option, repair or replacement of defective parts within the warranty period. Refunds are governed by Section 8.
- Proof: valid proof of purchase and, where applicable, serial numbers and photos/video of the issue.
- Outside India: for approved claims, warranty replacement parts are sent at our cost. We may require return of the failed part; if so, we will arrange or reimburse shipping where the claim is approved.
- Traders: unless mandatory law provides otherwise, warranty period is 12 months from delivery.
- Consumer notice: please check deliveries promptly; we request notice of visible shortages/defects within 5 working days (request only; your statutory rights remain). For troubleshooting guides, visit Support.
10) Repairs & Service (Special Conditions)
- Repairs may be performed by us or an authorized distributor; we choose the service location.
- We may use qualified personnel or subcontractors.
- You must provide a clear defect description and all information reasonably required to diagnose the issue.
- Unless otherwise agreed, you must ship items to us for repair at your expense and risk; we recommend insurance and discreet packaging.
- Return shipping after repair is at your expense unless covered under warranty. Risk passes to you when we hand to the carrier.
- Repair return issues must be raised within 3 days of receiving the repaired item.
11) Abandoned Property (Service/Repair Items)
- If we request information/approval to proceed and receive no response for 30 days, we may store the item and charge reasonable storage fees.
- If an item remains unclaimed for 90 days after we notify you of completion or required action, we may treat it as abandoned and dispose of it as permitted by law to recover costs.
12) Safety, Installation & Assumption of Risk
- Assemble strictly per our instructions, using appropriate tools/torque values; secure to suitable surfaces and periodically re-check critical fasteners.
- You are responsible for ensuring your seat, mounting surfaces, and structure are adequate for loads generated during use.
- By using our products, you acknowledge inherent risks of mechanical equipment and agree to use them responsibly and within specifications.
13) Limitation of Liability
- We are liable without limitation for death/personal injury caused by our negligence, fraud/fraudulent misrepresentation, and any liability that cannot be limited under applicable law.
- For other losses, if we negligently breach an essential contractual duty, liability is limited to the foreseeable, typical loss.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential losses; lost profits/revenue; data loss; downtime; or third-party costs.
- Cap: our aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
- The above applies also to our legal representatives and agents.
14) Reservation of Supply / Availability
If our suppliers fail to deliver despite a proper covering transaction not caused by us, we may withdraw from the contract. We will promptly inform you and refund any payments received.
15) Export Controls & Sanctions
You represent that you are not subject to trade sanctions and will not use, export, or re-export products in violation of applicable export control or sanctions laws. We may cancel orders that would violate such laws.
16) Intellectual Property
All website content, product designs, images, manuals, and trademarks are owned by or licensed to Simforge. No rights are granted except as necessary to use the products you purchase. You may not copy our materials without written permission.
17) Governing Law & Jurisdiction
- These Terms are governed by the laws of India, excluding conflict-of-law rules and the UN CISG.
- Exclusive venue is the competent courts at our place of business in Pune, India. If you are a consumer, mandatory local consumer protections/venues may also apply.
18) Dispute Resolution
We are neither obliged nor prepared to attend an alternative dispute resolution procedure before a consumer ADR entity, but we aim to resolve issues amicably. Please contact us first.
19) Changes to These Terms & Linked Policies
We may update these Terms and related policies (Shipping, Returns, Warranty, Privacy). The versions posted on our website at the time of order apply to that order.
20) Severability, No Waiver, Assignment, Entire Agreement
- If any provision is held invalid, the remainder stays in effect.
- Failure to enforce a provision is not a waiver.
- We may assign/subcontract our rights and obligations; you may assign only with our written consent.
- These Terms, together with your order confirmation and any policy links referenced herein, form the entire agreement between you and us regarding the order.
